MGCyber's
Terms of Services ( TOS ) are provided to give users :: those who get ours services directly by paying for it as well as those who use our internet services indirectly, a clear vision that what we expect from them while using MGCyber services.

Use of MGCyber's Services constitutes acceptance and agreement to MGCyber's TOS (Terms of Service).

a. Network Usage & Performance
Domains (accounts )  hosted on MGCyber are on Shared resources so you ( customer ) are prohibited to do excessive use of our server's CPU, memory, diskspace, sessions time  which can cause negative impact on other customers may leads to immediate termination of your account. MGCyber reserves the right for termination of account according to this Policy.

b. Server Space & Bandwidth 
We always reserves (keep free) 4,000 MB to 15,000 of free space and we also make space by removing old logs so keeping enough room on servers. We also allot bandwidth on the basis of your account and on running out of the bandwidth you will recieve a mail and you will have to pay $5.5 per GIG of extra bandwidth.

c. Technical Support 
MGCyber provides technical support, however we do not provide support for actities which are not directly related to your hosting i.e. script installation, web page uploading, web page mainatainces , images etc. on your ( customers ) particular account.

d. Backups 
We however always try to provide you best, secure, safe and reliable hosting but in the case of any unfortunate event we (MGCyber) are NOT liable to any loss of data, money, time, effort etc.. to you. But for gesture of good faith we will attempt to recover your files or data but we don't make any promises that will your data braught successufuly or not. So it is Client's ( customer ) responsibility to keep backup of database localy. Backup/restore are not the options with this hosting.

e. Contents
All services provided by MGCyber may only be used for lawful purposes. Transmission, storage or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless MGCyber from any claims resulting from the use of the service which damages the subscriber or any other party. All pornographic and sex related material & trade is prohibited on MGCyber servers. Also site doing or related to any illegal activity which harms the MGCyber internet services or any other services on the internet are not allowed. The links to such sites are also treated as violation of our Policy.  
>We do not allow IRC or IRC bots to be operated on our servers. 
>We not allow eggdrops to be operated on our servers. 
>We do not allow BNC to be operated on our servers.
MGCyber will be the sole arbiter in determining violations of these provisions.
Example of the Objectionable contents :

• Pornographic / Adult sites
• Cracks / password providing sites
• Email lists ( spamming )
• Warez Sites
• Pirated software download
• Site containing hatred to others 

f.  Commercial use & Emails 
Spamming or sending unsolicited emails or supporting a spam selling material from a domain/email maintained on our servers ( MGCyber ) is STRICTLY prohibited. MGCyber will be the sole arbiter as to what constitutes a violation of this provision.

g. Server Misuse / Abuse
Any attempt to undermine or cause harm to a server, or customer, of MGCyber is strictly prohibited.

h. General Information about Services
We encourage the idea of freedom over the internet so we do not actively monitor user (customer) activity under normal condition, we do not put any editorial control over website content, emails or any material created, used on or through MGCyber except certain cases. According to this TOS we can remove, edit, block any of the data which we may find objectionable, illegal, may held us liable. Also we can ask for cooperation from lawful authority, third party to help us to investigate any illegal, crime or civil wrong doing. MGCyber reserves the right to remove/terminate your account on violation of our TOS without ANY PRIOR NOTICE. 

i. Violation of Terms of Services
The following constitute the violation of our Terms of Services (TOS)

• Misuse of Software: Use of software or any device that would facilitate a continued connection, i.e. pinging, while using MGCyber services could result in suspension/cancellation of service. 
• Harm to minors: Use of the MGCyber service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography
• Illegal use:MGCyber's services may not be used for illegal purposes, or in support of illegal activities. MGCyber reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing. 
• Threats: Use of the MGCyber service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.
• Fraudulent activity: Use of MGCyber service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as "pyramid schemes," "ponzi schemes," and "chain letters." 
• Harassment: Use of the MGCyber service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another.
• Forgery or impersonation: Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying infirmation is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.
• Unsolicited commercial e-mail / Unsolicited bulk e-mail (SPAM) Use of the MGCyber service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of the offending MGCyber account. 
• Usenet SPAMing: MGCyber has a zero tolerance policy for the use of its network for the posting of messages or commercial advertisements, which violate the rules, regulations, FAQ or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted. 
• Unauthorized access: Use of the MGCyber service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of MGcyber's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending MGCyber account is subject to immediate termination
• Copyright or trademark infringement: Use of the MGCyber service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
• Collection of personal data: Use of the MGCyber service to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
• Network disruptions and unfriendly activity: Use of the MGCyber service for any activity which affects the ability of other people or systems to use MGCyber Services or the Internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual's computer system will result in immediate account termination. MGCyber will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.
• Fraud: Involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it. 
• Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right: Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. 
• Distribution of Viruses: Intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in the immediate termination of the offending account
• Third Party Accountability: MGCyber subscribers will be held responsible and accountable for any activity by third parties, using their account, that violates guidelines created within the Acceptable Use Policy 

j. Privacy
MGCyber do not collect any information about our customer but to maintain good level of service and for lawful purposes we do ask for  information about our customers which is otherwise only required for the information purposes. MGCyber DO NOT disclose any of the users private information. however you ( customer )  are also asked to provied correct information to maintain high level of services.

k. Security 
It is your ( customer ) responsibility to keep his account safe. If any activity done on your account which is objectionable , illegal either by you or your employee, your family member, your friend, guest is totally your (customer) responsibility. You, therefore are advised to keep proper action to avoid such activities and do keep changing your password regularly. 

• You (customer) are not allowed to share password with some one else.
• Use of our network resources to do activities such as gaining access to other system or our system which is not allowed is strictly prohibited. This may include,  but not limited to excessive use of network resources, Denial of services, trying to overload services, trying crash the host etc.
• Any subscriber found in such activities may incur civil or criminal liabilties. MGCyber will fully cooperate in investigation with other site who are affected by such activities as well as MGCyber can take the help of the lawful authorities to sort out, to stop such criminal activities.

l. Refusal of Services
We reserve the right to refuse, cancel, or suspend service at our sole discretion. All Sub-Networks, distributive hosting sites and dedicated servers of MGCyber must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate account deactivation. MGCyber reserves the right to deny the refund of any money paid thus far if these policies are broken.

m. Revision of Policies 
MGCyber reserves the right to modify, revise, amend this TOS, our other policies and agreement at any time & in any manner.
